These Terms and Conditions of Use (the "Terms") govern access to and use of the digital service called Andy Partner (the "Service"), owned, operated and administered by Andesphere SpA and Andesphere Ltd. (collectively, the "Provider"), including their affiliates, subsidiaries, related companies and strategic partners.
Use of the Service by the user constitutes full, express, free, voluntary, informed and irrevocable acceptance of these Terms. If the user disagrees with any provision, they must refrain from using Andy Partner. Registering, accessing, browsing or otherwise using the Service constitutes unequivocal consent to the Terms.
The user further acknowledges and agrees that the Provider may amend these Terms at any time, and continued use of the Service after such amendments constitutes tacit acceptance of the new provisions.

These Terms establish the rules and conditions governing the use of Andy Partner, an artificial intelligence platform designed to answer queries, generate content, process information, optimize workflows and deliver digital support to individuals and organizations.
The Service is provided "as is" without warranties of uninterrupted operation, error-free responses, absolute accuracy or fitness for a particular purpose.
The user understands that Andy Partner and every current and future Andesphere SpA and Andesphere Ltd. program are subject to ongoing technological evolution; therefore, Service features, characteristics and scope may be modified, updated or removed at any time without generating any right to claims or compensation.
The user expressly, freely, consciously and irrevocably authorizes the Provider to collect, store, record, process, analyze, transfer, share and use their Personal Data and Usage Data, both within Andy Partner and any other current or future software, application, platform or digital system of Andesphere SpA and Andesphere Ltd.

The user also authorizes their data to be shared, communicated and transferred to related companies, affiliates, subsidiaries, controlling entities or strategic partners of Andesphere SpA and Andesphere Ltd., within and outside Chile, provided such data is used exclusively for projects associated with the development, enhancement, integration and delivery of technology services.
The user expressly consents to storing and transferring their data to servers located inside or outside the country, under reasonable security standards and in compliance with applicable regulations.
The consent granted extends not only to the Andy Partner Service but also to any future program, application or system of Andesphere SpA and Andesphere Ltd., even if it is not specifically identified at the time of acceptance.

The user acknowledges that all intellectual and industrial property rights related to Andy Partner and every Andesphere SpA and Andesphere Ltd. software product are the exclusive property of the Provider.
The user acquires only a limited, personal, non-exclusive and non-transferable right to use the Service, without any transfer of intellectual property rights.
Reproduction, distribution, reverse engineering, decompilation, modification, commercial exploitation or any other unauthorized use of Andy Partner or its content is strictly prohibited.
The Provider and its related companies undertake to treat user data confidentially, except when:
The Provider may modify these Terms at any time. Modifications take effect upon publication on Andy Partner or through other official Provider channels.
Continued use of the Service after publication of modifications constitutes tacit and irrevocable acceptance of the changes.
The Provider may suspend or cancel user access in cases of breach of these Terms, misuse, technical decisions or force majeure.
Users may stop using Andy Partner at any time without prejudice to outstanding payment obligations or existing liabilities.
These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the Ordinary Courts of Justice of the city of Puerto Montt, and the user expressly waives any other jurisdiction.

The user declares they have read, understood and fully accepted these Terms, and grants free, express and informed consent for their personal and usage data to be processed in Andy Partner, in all current and future Andesphere SpA and Andesphere Ltd. software, and by their related companies, affiliates, subsidiaries and strategic partners.
The user further acknowledges that the Provider does not guarantee specific results, assumes no responsibility for interpretations made by the user, and is exempt from any claim beyond what is expressly stated herein.
